Critical reasons

• Outsourcing is prohibited

  The Private Employment Agencies (Amendment) Act 2017 made outsourcing prohibited for licensed agencies, and outsourced worker permits stopped in 2019. In construction, the only legal channel is CLAB, a scheme run by CIDB.

  The risk is yours, not the supplier’s. Workers whose permits name another company are illegal on your site. Under section 55B of the Immigration Act 1959/63, the fine is RM10,000 to RM50,000 per worker, with up to a year in jail.

• No employment, no control

  Workers who aren’t yours can be moved to another client, repriced at renewal, or pulled mid-season. You have no contract of employment to fall back on.

• Expensive in the long run

  A supply rate is charged every month for as long as you keep the worker, with no end date. Your own quota costs more in the first year, then settles at renewal prices. Over three years the supply route usually costs more, and you are left with no quota and no employee of your own.
